These Terms of Service ("Terms") govern your access to and use of retirementsuccessclub.com and any related subdomains, content, tools, assessments, guides, communications, and services (collectively, the "Site" and "Services") provided by Retirement Success Club ("Retirement Success Club," "we," "us," or "our").
Please read these Terms carefully. By accessing or using the Site, submitting any form, requesting any resource, taking any assessment, or otherwise engaging with the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site or Services.
1. Eligibility:
You must be at least 18 years old and capable of forming a legally binding contract to use the Site or Services. By using the Site, you represent that you meet these requirements. The Site is intended for residents of the United States only. We make no representation that the Site or Services are appropriate or available for use outside the United States.
2. Nature of the Services — Important Disclaimers:
A. Educational and Informational Purpose Only:
The Site provides educational content, tools, calculators, checklists, assessments, and guides intended to help users learn about retirement planning topics, including topics specific to federal employees. All content on the Site is for general informational and educational purposes only and is not intended as, and should not be relied upon as, investment advice, tax advice, legal advice, insurance advice, or financial planning advice tailored to your individual circumstances.
B. We Are Not a Licensed Adviser:
Retirement Success Club is not a registered investment adviser, broker-dealer, insurance company, insurance agency, law firm, accounting firm, or fiduciary. We do not provide personalized recommendations regarding the purchase or sale of securities, insurance products, annuities, or any other financial product. We do not manage assets, hold custody of client funds, or execute transactions.
C. No Advisory Relationship:
Use of the Site, submission of any form, completion of any assessment, or receipt of any educational material does not create an advisory, fiduciary, agency, brokerage, attorney-client, accountant-client, or any similar professional relationship between you and Retirement Success Club.
D. Federal Government Affiliation Disclaimer:
Retirement Success Club is not affiliated with, endorsed by, sponsored by, or otherwise connected to the United States government, the Office of Personnel Management (OPM), the Thrift Savings Plan (TSP), the Federal Retirement Thrift Investment Board (FRTIB), the Social Security Administration, the Centers for Medicare & Medicaid Services, the Department of Homeland Security, U.S. Immigration and Customs Enforcement, U.S. Customs and Border Protection, or any other federal agency, department, or instrumentality. Any references to federal benefits, retirement systems, or programs are for educational discussion only.
E. Accuracy of Information:
Federal benefits, tax laws, retirement rules, and program details change over time. While we make reasonable efforts to keep our content accurate, we make no representation or warranty that any information on the Site is current, complete, or error-free. 3. Advisor Partner Referrals:
A. Independent Third Parties:
The Site may offer to connect you with independent licensed insurance and financial professionals ("Advisor Partners") who may be able to assist with your retirement planning needs. Advisor Partners are independent third parties. They are not employees, agents, representatives, partners, or joint venturers of Retirement Success Club.
B. No Endorsement of Specific Advice:
Retirement Success Club does not supervise, control, or guarantee the advice, recommendations, products, services, conduct, or performance of any Advisor Partner. Inclusion in our network does not constitute an endorsement of any specific recommendation, product, or strategy that an Advisor Partner may offer. You are solely responsible for evaluating any Advisor Partner and their recommendations before engaging their services or purchasing any product.
C. Compensation Disclosure:
Retirement Success Club may receive compensation, fees, or other consideration from Advisor Partners in connection with referrals, leads, marketing services, or platform access. This creates a financial incentive for us to refer you to Advisor Partners who participate in our referral arrangements. Despite this incentive, we represent that we do not refer users based on commission rates and that you are under no obligation to engage any Advisor Partner we refer you to.
D. Your Independent Decision:
Any decision to engage an Advisor Partner, purchase any product, implement any strategy, or take any action based on information received through the Site or from an Advisor Partner is your independent decision, made at your own risk. Retirement Success Club has no liability for any advice given, products sold, or actions taken by an Advisor Partner.
4. How We Share Your Information:
We share your information in the following circumstances:
A. With Advisor Partners:
When you request a strategy session, consultation, or to be connected with a retirement specialist, we may share your contact information and the information you provided in assessments or forms with one or more independent licensed insurance and financial professionals ("Advisor Partners") so that they can contact you. By submitting your information through forms designated for this purpose, you expressly consent to this sharing.
Our Advisor Partners are independent businesses and not employees, agents, or representatives of Retirement Success Club. Once your information is shared with an Advisor Partner, that Advisor Partner's own privacy practices will apply to their use of your information. We encourage you to review the privacy policies of any professional you choose to work with.
B. With Service Providers:
We share information with third-party vendors who help us operate our business, including:
-Customer relationship management and marketing automation platforms
-Email and SMS delivery services
-Website hosting and analytics providers
-Advertising and retargeting platforms
-Payment processors (if applicable)
-Calendar and scheduling tools
These service providers are authorized to use your information only as necessary to provide services to us.
C. For Legal and Safety Reasons:
We may disclose information when we believe in good faith that disclosure is necessary to:
-Comply with applicable law, subpoena, court order, or legal process
-Enforce our terms of service or other agreements
-Protect the rights, property, or safety of Retirement Success Club, our users, or others
-Investigate or respond to suspected fraud or unlawful activity
D. In a Business Transfer:
If Retirement Success Club is involved in a merger, acquisition, sale of assets, or similar transaction, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your information.
E. With Your Consent:

We do not sell your personal information for monetary consideration to third parties for their independent marketing purposes. Some sharing described above (such as with Advisor Partners) may, under certain state privacy laws, be considered a "sale" or "sharing" of personal information; see Section 10 for your rights.
5. Acceptable Use:
You agree not to:
-Use the Site for any unlawful purpose or in violation of any applicable law or regulation
-Submit false, misleading, or fraudulent information
-Attempt to gain unauthorized access to the Site, our systems, our accounts, or any user data
-Reverse-engineer, decompile, scrape, harvest, or attempt to extract source code or data from the Site, except as permitted by law
-Use any automated system (bot, scraper, crawler) to access the Site, except for legitimate search engine indexing
-Interfere with or disrupt the operation of the Site, including by introducing viruses, malware, or other harmful code
-Use the Site or any content from the Site to develop, train, or fine-tune any artificial intelligence or machine learning model without our express written permission
-Copy, reproduce, distribute, republish, modify, create derivative works from, or commercially exploit any content from the Site without our express written permission
-Impersonate Retirement Success Club, any of our personnel, or any Advisor Partner
-Use the Site to harass, abuse, or harm any person
-Frame, mirror, or otherwise replicate the Site or any portion of it
6. Intellectual Property:
A. Our Content:
All content on the Site — including text, graphics, logos, images, photographs, illustrations, audio, video, software, assessments, calculators, checklists, guides, and the selection and arrangement thereof — is owned by or licensed to Retirement Success Club and is protected by United States and international copyright, trademark, and other intellectual property laws.
B. Limited License:
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use in evaluating retirement planning information for yourself. This license does not include any right to:
-Republish, redistribute, or commercially use any content
-Use the content to build any competing service or product
-Remove any copyright, trademark, or proprietary notices
-Use any of our trademarks, service marks, or branding without express written permission
C. Your Submissions:
By submitting any content to us — including form responses, assessment answers, survey responses, testimonials, comments, replies to emails, or other communications — you grant Retirement Success Club a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, and display the submission for the purpose of operating, improving, and marketing the Services. You represent that you have the right to grant this license and that your submissions do not infringe on the rights of any third party.
D. Testimonials:
If you provide a testimonial, review, or endorsement, you consent to our use of it (in whole or in part, with or without your name and likeness as you authorize) in marketing materials, on the Site, and in advertising. You may revoke this consent prospectively by contacting us, but revocation does not affect prior uses.
7. Communications Consent:
By providing your email address, phone number, or other contact information, you consent to receive communications from Retirement Success Club as described in our Privacy Policy, including marketing emails, transactional emails, SMS or MMS text messages (where you have opted in), and phone calls (including calls placed using automated dialing technology where you have requested contact). Consent to marketing communications is not a condition of receiving any free resource or of any purchase. You may withdraw consent at any time as described in our Privacy Policy.
8. Third-Party Links and Content:
The Site may contain links to third-party websites, services, or content that are not owned or controlled by Retirement Success Club. We are not responsible for the content, privacy practices, or conduct of any third-party site or service. Your interactions with any third party are solely between you and that third party.
9. Disclaimer of Warranties:
THE SITE AND ALL CONTENT, TOOLS, ASSESSMENTS, GUIDES, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
To the fullest extent permitted by law, Retirement Success Club disclaims all warranties, including but not limited to:
-Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
-Warranties that the Site will be uninterrupted, secure, error-free, or free of viruses or harmful components
-Warranties regarding the accuracy, completeness, reliability, or timeliness of any content
-Warranties regarding the conduct, qualifications, advice, or performance of any Advisor Partner
-Warranties that any retirement, investment, tax, or insurance outcome will be achieved
You use the Site and Services at your own risk.
10. Limitation of Liability:
TO THE FULLEST EXTENT PERMITTED BY LAW, RETIREMENT SUCCESS CLUB AND ITS OFFICERS, DIRECTORS, MEMBERS, OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, INVESTMENTS, RETIREMENT BENEFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, ANY CONTENT ON THE SITE, ANY ADVICE OR ACTION TAKEN BASED ON THE SITE, OR ANY INTERACTION WITH AN ADVISOR PARTNER, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE, THE SERVICES, OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification:
You agree to indemnify, defend, and hold harmless Retirement Success Club and its officers, directors, members, owners, employees, contractors, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
-Your use of the Site or Services
-Your violation of these Terms
-Your violation of any law or the rights of any third party
-Any information you submit, including any false or misleading information
-Any decision you make or action you take based on Site content or interaction with an Advisor Partner
12. Governing Law:
These Terms are governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of laws principles. You agree that any legal action or proceeding arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Lafayette Parish, Louisiana, and you consent to the personal jurisdiction of those courts.
13. Dispute Resolution and Arbitration:
Please read this section carefully — it affects your legal rights.
A. Informal Resolution:
Before filing any formal claim, you agree to first contact us at the address in Section 18 and attempt to resolve the dispute informally for at least sixty (60) days.
B. Binding Arbitration:
If the dispute is not resolved informally, you and Retirement Success Club agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site or Services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Louisiana, or by video or telephone if the amount in controversy is under $25,000. Judgment on the award may be entered in any court of competent jurisdiction.
C. Class Action Waiver:
You and Retirement Success Club agree that any dispute shall be brought in your individual capacity only, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
D. Exceptions:
Notwithstanding the above, either party may bring an individual action in small claims court, and either party may seek injunctive or equitable relief in court to protect intellectual property rights.
E. Opt-Out:
You may opt out of this arbitration agreement by sending written notice to us at the address in Section 18 within thirty (30) days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
14. Changes to These Terms:
We may modify these Terms at any time. When we do, we will update the "Last Updated" date at the top. Material changes will be communicated by email or prominent notice on the Site. Your continued use of the Site after changes take effect constitutes acceptance of the modified Terms. If you do not agree to modified Terms, you must stop using the Site.
15. Termination:
We may suspend or terminate your access to the Site or Services at any time, with or without cause and with or without notice, including if we believe you have violated these Terms. Upon termination, your right to use the Site immediately ceases. Sections that by their nature should survive termination — including disclaimers, limitation of liability, indemnification, governing law, dispute resolution, and intellectual property provisions — shall survive.
16. Severability:
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.
17. Entire Agreement:
These Terms, together with the Privacy Policy and any additional terms applicable to specific Services, constitute the entire agreement between you and Retirement Success Club regarding the Site and Services, and supersede any prior agreements on the subject matter.
